These terms cover the use of Balaay, an AI receptionist that answers a business’s phone calls, answers questions from what the business has told it, and books appointments.

Not yet complete. The contracting legal entity and the governing law are outstanding. Until they are filled in, this page describes the service accurately but is not a finished contract.

What the service does

Balaay answers inbound calls, identifies why the caller rang, answers from the information the business has supplied, captures the caller’s details, books, moves or cancels appointments in Balaay’s own schedule, escalates urgent calls according to rules the business sets, and sends confirmations.

What it does not do

It does not write into whatever scheduling system the business already runs on. Appointments live in Balaay’s schedule. Connectors are arranged during setup, and none is in production use today — ask about your own system.
It does not read the business’s own calendar unless that calendar has been connected and verified. Where it has not, a time blocked only in the business’s calendar can still be offered.
It is not a medical, legal or financial adviser. It answers from what the business supplied and hands off anything that needs professional judgement.
It is not an emergency service. It escalates urgent calls to the business; it cannot dispatch help.
It is not described as HIPAA-compliant without a signed business associate agreement in place.

The business’s responsibilities

The business is responsible for the accuracy of what it tells Balaay — hours, services, prices and policies are answered from its own configuration. It is also responsible for having a lawful basis to process its callers’ data, for setting call recording appropriately for its jurisdiction, and for reviewing what Balaay did on its behalf.

Availability

Balaay depends on third parties — a telephony carrier, a speech model, cloud hosting. It is offered without an uptime guarantee unless one is agreed separately in writing. Where Balaay cannot complete an action it says so rather than reporting success.

Billing and cancellation

Plans are billed monthly in advance. A business can cancel at any time and keeps service to the end of the period already paid for. Setup fees, where charged, are stated before purchase.

Data

How caller data is handled, how long it is kept and how it is deleted are set out in the Privacy Policy, which forms part of these terms. A business’s data belongs to the business and is exportable.

Liability

Balaay’s liability is limited to the fees paid in the twelve months before a claim. It is not liable for a business’s lost profit or lost opportunity. Nothing here limits liability that cannot lawfully be limited.
